2. Scope of Application
These Terms & Conditions apply to all orders placed through our website by customers within the European Union.
By placing an order, you agree to these Terms.
3. Products
BaKaTa offers curated jewelry pieces made by independent artisans.
Minor variations in texture or color are a natural result of the crafting process and are not considered defects.
Each design is produced in limited quantities.
4. Prices and Taxes
All prices shown on our website are in euros (€) and include VAT (Value Added Tax) applicable in the Netherlands.
Shipping costs are displayed separately before checkout.
5. Orders and Payment
By completing an order, you confirm that the information you provide is accurate and complete.
We accept payments via secure payment providers such as Stripe.
Your payment will be processed immediately upon placing the order.
We reserve the right to cancel or refuse any order in case of suspected fraud or payment issues.
6. Shipping and Delivery
We currently ship to selected European countries. Available destinations are shown at checkout.
If you wish to order from another country, please contact us at hello@bakata.nl before placing your order.
Orders are shipped via PostNL or equivalent service.
Estimated delivery time: Netherlands 1- 3 business days. Europe 3–8 business days (depending on destination).
Delays caused by customs or postal services are beyond our control.
7. Returns and Refunds
You have the right to withdraw from your purchase within 14 days after receiving your order, without giving any reason, in accordance with EU consumer law. To request a return, please contact us at hello@bakata.nl with your order number and the items you wish to return. Returned items must be unused, unworn, and in their original packaging and condition. Some items may not be eligible for return for hygiene or customization reasons. Please refer to our Refund & Returns Policy for full details. Return shipping costs are the responsibility of the customer. Refunds will be issued to the original payment method once the returned items have been received and inspected. Please refer to our Refund & Returns Policy for full details.

8. Exclusions from Return
Certain items may not be eligible for return:
Earrings and ear cuffs can only be returned if they are unworn, in their original packaging, and show no signs of use, for hygiene reasons. Custom or made-to-order pieces cannot be returned unless they are defective.
9. Defects and Warranty
If you receive a defective or damaged product, please contact us within 7 days of receipt.
We will replace or refund the item after verification.
The warranty does not cover normal wear, damage due to misuse, or lack of care.
10. Care Recommendations
To maintain your jewelry’s appearance:
- Avoid contact with water, perfume, or cosmetics.
- Store each piece separately in a soft pouch.
- Clean gently with a dry, soft cloth.
11. Intellectual Property
All designs, texts, photographs, and brand elements appearing on this website are the property of BaKaTa or its creators and are protected by copyright and design laws.
Reproduction or commercial use without written consent is prohibited.
12. Privacy and Data Protection
We process personal data according to our Privacy Policy, in compliance with the EU General Data Protection Regulation (GDPR).
13. Limitation of Liability
We shall not be liable for any indirect, incidental, or consequential damages resulting from the use or inability to use our products or website, except as required by law.
14. Applicable Law and Jurisdiction
All contracts are governed by Dutch law, excluding the UN Convention on Contracts for the International Sale of Goods.
Disputes shall be submitted to the competent courts of the Netherlands, without affecting your statutory rights as an EU consumer.

We reserve the right to update or modify these Terms at any time.
